ABOUT

COLLINS KILGORE

Before joining the plaintiffs’ bar, Collins spent more than a decade practicing at one of the nation’s most respected large defense firms. He specializes in consumer class actions and other consumer protection and mass tort claims, particularly those involving deceptive consumer product advertising, environmental marketing, and toxics in food and product packaging. Collins’ strategic vision and litigation style has resulted in many wins for clients at the trial and appellate level. His work at the Ninth Circuit Court of Appeals has helped to shape the “reasonable consumer” test for deceptive marketing claims.

Collins’ recent matters include having served as the primary counsel in B.A.D.J. v. United States, 21-cv-00215 (D. Az.), where he represented an asylum-seeking mother and her eight-year-old daughter suing the federal government under the Federal Tort Claims Act after government agents executing the Trump Administration’s 2018 “Zero Tolerance” policy unlawfully separated Plaintiffs for more than three years. The egregious facts outlined in Plaintiffs' complaint were featured in a March 18, 2022 letter to President Biden from Senator Durbin and nineteen other senators, who urged the U.S. government to provide a fair settlement to Collins’ clients and hundreds of other separated migrant families with pending claims. Collins’ client received an in-person apology from the Secretary of the Department Homeland Security for the ordeal she and her daughter endured. The U.S. government ultimately agreed to settle the case.

Collins is a member of the firm’s public client team, litigating multiple matters for state attorneys general. Additionally, he focuses on cases involving the Magnuson-Moss Warranty Act, ERISA, data privacy and security matters, whistleblower complaints under the False Claims Act, and mass tort claims. His history of pro bono cases includes advocacy in and out of the courtroom to protect the rights of migrants, veterans, and those seeking reproductive services.
